# Can a Massachusetts A&B case continue if the victim does not want to press charges?

Yes. In Massachusetts, the prosecutor (not the alleged victim) decides whether to file charges. Even when the alleged victim recants or refuses to testify, the state can prosecute using 911 recordings, body cam footage, medical records, and other evidence. Non-cooperation weakens the state's case but does not automatically end it.
