## How Massachusetts Sobriety Checkpoints Work

Massachusetts State Police run sobriety checkpoints throughout the year, often supported by local departments and funded through Highway Safety Division grants. In 2026, the first Massachusetts State Police sobriety checkpoint ran January 2 into January 3, followed by additional checkpoints in early 2026. A third 2026 checkpoint was announced for the southeastern Massachusetts area, which includes New Bedford.

### Constitutional Requirements for a Lawful Checkpoint

Under Massachusetts constitutional law, a sobriety checkpoint has to meet all of the following:

- **Advance approval.** The checkpoint location and time must be pre-approved by a supervisor, not chosen ad hoc.

- **Neutral stopping formula.** Officers must stop cars according to a defined pattern (every car, every third car, etc.) so they cannot single out specific drivers.

- **Advance public notice.** The checkpoint has to be advertised in advance through press releases and public channels.

- **Signage.** Warning signs must be visible ahead of the checkpoint so drivers have the option to turn off legally.

- **Brief detention.** Each stop must be brief, only long enough for the officer to check for impairment signs.

- **Written operational plan.** Officers must follow a documented plan that the defense can request in discovery.

- **Safety measures.** The location and setup must protect drivers and officers.

If any of these elements is missing or defective, the checkpoint is unconstitutional and evidence obtained gets suppressed on motion.

## Legal Turn-Offs and Avoiding a Checkpoint

Turning around on a public road before entering a checkpoint is not illegal per se. Officers may follow a vehicle that turns off and observe for any actual traffic violation that provides reasonable suspicion for a separate stop. An illegal U-turn, sudden swerving, or crossing the double yellow to avoid the checkpoint gives the officer a legitimate basis to stop the vehicle apart from the checkpoint itself.

The safer move for sober drivers is to proceed through the checkpoint politely. For drivers who have been drinking, the safer move is not to drive in the first place.

## What Officers Look For at the Checkpoint Contact

The initial checkpoint stop is supposed to be brief. Officers scan for:

- Odor of alcohol on breath or from the vehicle

- Bloodshot or watery eyes

- Slurred speech or delayed responses

- Fumbling with documents

- Open containers visible

- Difficulty understanding simple questions

Any of these signs pulls the vehicle out for secondary investigation. From that point on, the case proceeds as any DUI stop would - field sobriety tests, arrest decision, transport to the station, chemical test request.
