For certain serious felonies (armed robbery, home invasion, drug trafficking, sex offenses), the prosecutor can move for a Section 58A hearing under M.G.L. c. 276. If granted after evidentiary hearing, the defendant is held without bail through trial regardless of any cash amount that could be posted. Defense at a 58A hearing requires strong evidence rebutting the danger allegation.
